A legal disclaimer

Welcome to FIT BODY STUDIO. These Terms & Conditions (“Agreement”) govern your access to and use of our personal training services, whether in-studio or online. By purchasing any services, scheduling a session, or accessing our facilities or platforms, you agree to be bound by this Agreement.

1. Services Provided

FIT BODY STUDIO provides private, in-person personal training sessions, as well as online coaching services. All services are personalized, non-transferable, and available by appointment only.

2. Session Expiration and Scheduling

All training packages must be used within six (6) weeks from the date of the first scheduled session.
No extensions, rollovers, or credits will be granted for unused sessions after this period.
Clients are solely responsible for scheduling all sessions in advance to ensure timely use.

3. Cancellation and No-Show Policy

Cancellations or rescheduling must be made no less than twenty-four (24) hours prior to the scheduled session.
Sessions canceled within 24 hours of the appointment or missed without notice will be forfeited and not refunded or rescheduled.
Repeated late cancellations or no-shows may result in termination of training services at FIT BODY STUDIO’s discretion.

4. Payment Terms

All services must be paid in full in advance of training. No sessions will be booked or confirmed until payment is received.
All sales are final. There are no refunds, credits, exchanges, or transfers under any circumstances.
Pricing is subject to change without notice; however, confirmed packages already paid in full will be honored at the agreed-upon rate.

5. Non-Transferability

Training sessions and packages are non-transferable and may only be used by the individual listed on the original purchase.
Shared sessions are not permitted.

6. Client Conduct

Clients are expected to behave respectfully toward trainers, staff, and fellow clients.
FIT BODY STUDIO reserves the right to terminate any service or deny access for disruptive, unsafe, or inappropriate behavior. No refunds will be issued in such cases.

7. Assumption of Risk & Waiver of Liability

By participating in services provided by FIT BODY STUDIO, clients affirm they are in good physical health and have consulted a medical professional where appropriate.
Clients assume all risks associated with physical exercise and agree to release FIT BODY STUDIO and its employees, contractors, and affiliates from any and all liability for injury, illness, or damages sustained while participating in training, including any related activities or use of equipment.
A signed waiver and release form is required prior to participation in any training services.

8. Online Coaching Services

Online coaching services are subject to the same non-refundable, non-transferable, and expiration policies as in-studio sessions.
Clients are responsible for implementing recommendations safely and notifying the coach of any changes to health, limitations, or access to equipment.

9. Intellectual Property

All materials provided by FIT BODY STUDIO, including training programs, meal plans, communications, and branding, are proprietary and protected under copyright law.
Clients may not reproduce, share, sell, or distribute any materials without prior written consent.

10. Governing Law & Dispute Resolution

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of New York.
Any disputes arising under this Agreement shall be resolved through binding arbitration in New York County, New York, and not in court, unless otherwise required by law.

11. Acknowledgment and Agreement

By purchasing, booking, or participating in services with FIT BODY STUDIO, you acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions. This Agreement is enforceable to the fullest extent permitted by law.
